DLG Markets GmbH, Eschborner Landstraße 122, 60489 Frankfurt am Main (hereinafter referred to as “DLG”) provides users* with an event app for its trade fairs (hereinafter also referred to as “Software”). The event app can be used as a web app via a web browser or as an app on a smartphone.
The event app enables users to plan their visit during the respective trade fair, obtain information about the exhibitors and make contacts.
The following Terms of Use govern the legal relationship between DLG and the users of the event app.
These Terms of Use apply both to consumers within the meaning of Section 13 BGB [German Civil Code] and to entrepreneurs within the meaning of Section 14 BGB.
The user irrevocably acknowledges the following Terms of Use. Any conflicting licence conditions or general terms and conditions shall not apply.
The user does not acquire any copyrights or industrial property rights through use.
DLG reserves the right to revise and amend the Terms of Use if this appears necessary and the user is not unreasonably disadvantaged as a result. Changes shall be deemed accepted by the user if DLG does not receive a written objection within the period set by DLG and if the user continues to use the app after the revised Terms of Use have been published.
The event app is operated by Expoplatform Ltd, 28 Chesterton Road, Cambridge, CB4 3AZ, UK.
All services and contents of the event app, in particular all logos, images, texts, graphics, animations, trademarks, audio files and software, are legally protected by copyright, moral rights, registered designs or by trademark, design, patent or labelling law, data protection and confidentiality rights or by other similar rights.
DLG may offer updates to the software. The user will be informed of this in the respective app store and can decide whether or not to install the update. DLG points out that only the latest version of the event app gives the user access to all functions of the software.
The user is prohibited from making changes and/or modifications to the event app. The user may not determine the source code of the software and undertakes to refrain from doing so. Section 69e UrhG [German Copyright Act] remains unaffected by this.
A compatible end device (smartphone) is required to use the event app.
The basic functions of the event app can be used without registration and without creating a user account. These include the programme, the exhibitor directory and the exhibitors’ products.
Any further use requires the registration of the user and the creation of a user account. Only persons aged 16 or over may register. Registration takes place by providing the so-called profile data (mandatory information): e-mail and name, as well as voluntary information such as job title, country of origin, structural data, business address and language. The details can be edited during registration or at any time afterwards.
The user relationship is established by installing the software, whereby DLG and the user conclude a contract on the use of the event app in accordance with these Terms of Use.
The user registers in the event app after entering his/her e-mail address by clicking on the “Login” button. If the user does not yet have a profile, he/she can create a new profile there by clicking on the “Registration” button.
The user then receives a confirmation e-mail with a link to validate his/her e-mail address. After clicking on the link in the e-mail, the user account is set up and the user relationship for extended access/login to the event app between the user and DLG in accordance with these Terms of Use is deemed to have been concluded.
The user relationship can be terminated at any time by closing the user account (see point 10 “Termination”).
The access data of registered users are personalised and non-transferable. They are only valid for the holder whose e-mail address, surname and first name were entered during registration. The user is responsible for the correct entry of his/her data. DLG excludes any liability in this respect. The user is responsible for all processes that take place via his/her user account. He/she is obliged to protect the access data from access by third parties.
In the event of concrete suspicion of misuse of the access data, DLG reserves the right to block the corresponding access data and to deny access to the event app or to deactivate and delete the user account. In such a case, all claims for reimbursement and compensation against DLG are excluded.
If, prior to registering in the event app, the user purchased a ticket for the event in the DLG ticket shop and registered there in order to purchase the ticket, his/her purchased tickets will be added to the ticket wallet of the event app. This is done using the e-mail address entered during registration, which is used to query the operator of the ticket shop (Aditus GmbH, Straße der Nationen 5, 30539 Hannover, Germany) as to whether the user has purchased a ticket for the event in advance. No automatic registration in the event app takes place when the event ticket is purchased in the ticket shop.
The event app offers registered users the opportunity to research and arrange contacts in relation to the respective trade fair. Use of the software is at the user’s own risk. DLG does not participate in the content of the communication and is not responsible for ensuring that such communication takes place.
The full-text search searches the event app for its content (exhibitors, products, conference programme and contact persons).
The company profile provides users with links to the companies’ social media channels, brief descriptions, contact persons, products, media attachments and general company information.
The networking function gives users the opportunity to make direct contact with exhibitors.
The “My Favourites” planner organises the user’s appointments and the selected favourites (speakers, exhibitors, products, events).
The chat is an open or closed means of communication, not tied to any specific occasion, that can be used for discussions and an open exchange within the event app. The private chat is only visible to the users involved.
The logged-in user can view the appointments agreed with exhibitors in the software in the appointment calendar. The user can also send appointment requests to exhibitors.
The route planner enables users to plan a route on the exhibition grounds. To do so, the user selects the exhibitor he/she wishes to visit and can indicate at which exhibitor he/she is currently located. The route planner is intended to support the user during his/her visit to the trade fair.
The mobile event app offers indoor navigation, which shows the user his/her current location on the site map. For this purpose, the event app accesses Bluetooth and the location permission of the end device. The location permission is technically required to detect the Bluetooth beacons installed on the exhibition grounds.
Use of indoor navigation is voluntary. The user can revoke the location permission at any time in the settings of his/her end device. The other functions of the event app can be used without restriction without location sharing.
Indoor navigation serves as an orientation aid for the visit to the trade fair. DLG gives no warranty for the accuracy of the position determination. Details on the processing of location data are governed by the DLG privacy policy.
Using the “Scan QR code” function in the mobile event app, the user can scan a QR code at the stands of participating exhibitors. These QR codes can be created by exhibitors for their respective stand or for their products. After scanning the QR code, the user receives information about the exhibitor or the respective product that the exhibitor has provided for this purpose. In return, the respective exhibitor receives the data, possibly including personal data, stored when the user registered. In this respect, the DLG data protection provisions apply.
The user can also use the camera of his/her mobile device. If the user has installed the event app, the event app opens after the QR code has been scanned with the integrated camera of the mobile device. Alternatively, the event website opens, where all information is available after login.
A tracking tool is used to continuously improve the event app and to enable exhibitors to get in touch with users as efficiently as possible. For this purpose, DLG uses the tracking tool provided by the operator of the event app. Tracking is activated after the user has given consent upon registration and cannot be deactivated independently.
DLG uses the information and data provided by the user to provide recommendations on contacts, content and functions that may be useful to the user. For example, DLG uses data and information about the user for event or contact suggestions. With an up-to-date and correct profile, the user helps DLG to make these recommendations relevant and accurate.
In all communication with other users, exhibitors, participants, speakers and other third parties, the user is responsible for complying with the statutory provisions. DLG is entitled at any time to exclude the user and to block his/her access to the user account if there are concrete indications that the user has violated applicable law or impaired or infringed the rights of third parties. This also applies if the content of the communication is unacceptable for other reasons.
In particular, the user is prohibited from:
When using the communication tools, it is also prohibited:
DLG is entitled at any time to remove communication content from the public communication tools immediately and without prior consultation with the user if there are concrete indications that statutory provisions have been violated.
The user relationship ends, without the need for notice of termination, when the software is deactivated after the end of the respective event.
Both the user and DLG may terminate this agreement at any time by notifying the other party. Upon termination, the user loses the right to access or use the event app and his/her user account. The user’s account will be deleted by DLG without undue delay. The user is obliged to delete the software stored on his/her end device without undue delay.
The user can send his/her notice of termination by e-mail to the following address: digital-plattform@dlg.org.
Unless otherwise stipulated below, the warranty shall be governed by the statutory provisions.
DLG gives no warranty for:
DLG shall not be liable for damage arising during use of the event app that is attributable to transmission errors, technical failures, interruptions due to maintenance work or other disruptions for which DLG is not at fault.
DLG is not liable for the content, information and data provided by users and excludes any liability in this regard.
DLG shall only be liable for intent and gross negligence. It shall also be liable for the negligent breach of obligations the fulfilment of which is essential for the proper performance of the contract, the breach of which jeopardises the achievement of the purpose of the contract and on the observance of which the user regularly relies. In the latter case, however, DLG shall not be liable for unforeseeable damage that is not typical for the contract.
DLG shall not be liable for slightly negligent breaches of other obligations.
The above exclusions and limitations of liability shall not apply in the event of culpable injury to life, limb or health caused by DLG or one of its legal representatives or vicarious agents.
Liability under the provisions of the German Product Liability Act (ProdHaftG) shall remain unaffected.
If contracts are concluded via the communication channels in the event app, DLG is not a contracting party to these contracts. The user is responsible for the processing and fulfilment of any contracts concluded. In this context, DLG shall also not be liable for any breaches of duty that may arise from these contracts.
DLG takes the protection of users’ personal data very seriously. User data is stored, processed and transferred in accordance with the applicable data protection regulations. The user’s data collected during registration in the event app, which may include personal data, is passed on to DLG by the operator Expoplatform Ltd.
Everything else is governed by the DLG privacy policy.
It is not permitted to record content published in the event app and/or make it accessible to third parties without the prior consent of the publishing user and/or participant/exhibitor.
The law of the Federal Republic of Germany shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction for all legal disputes arising from these Terms of Use is Frankfurt am Main, to the extent permitted by law.
The sole place of performance for delivery, performance and payment is Frankfurt am Main.
Should individual provisions of these Terms of Use or parts thereof be or become invalid, this shall not affect the validity of the remaining provisions. In this case, the parties undertake to agree on other provisions in place of the invalid provisions which come as close as possible to the legal and economic content of the invalid provision.
